Kolai – Terms and Conditions

Welcome to Kolai (the "Bot"). These Terms and Conditions ("Terms") govern your access to and use of Kolai's services and features on Discord. Please read these Terms carefully before installing or using the Bot. By adding Kolai to any Discord server or using any of its functionalities, you ("User" or "you") agree to be bound by these Terms. If you do not agree, do not install or use Kolai.

2. Eligibility

  • Age Requirement: You must be at least 13 years old (or the minimum age required by local law) to use Kolai. If you are under 18, you may only use the Bot under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • Compliance with Discord's Terms: By using Kolai, you also agree to comply with Discord's Terms of Service and any other applicable Discord policies.

3. Non-Financial and Non-Legal Advice Disclaimer

  • Educational Purpose Only: Any content, data, or information provided by Kolai is for educational and informational purposes only. It is not intended as financial, legal, or any other professional advice.
  • No Fiduciary Duty: We do not assume any fiduciary duty to users. If you require financial, legal, or other advice, please consult a qualified professional.
  • No Guarantees: We make no representations or warranties regarding the accuracy, reliability, or completeness of any information the Bot provides. All use of Bot-provided information is at your own risk.

4. Use of AI

  • AI-Generated Content: Kolai uses artificial intelligence ("AI") or machine learning models to generate or process responses. While we strive to maintain high-quality and helpful output, we do not have full control over the AI-generated content.
  • Accuracy and Reliability: AI responses may be incomplete, outdated, factually incorrect, or otherwise unsuited to your specific needs. You acknowledge and accept that you should not rely solely on AI-generated content for critical decisions.
  • User Responsibility: You agree to evaluate and verify any information or recommendations provided by Kolai. We are not liable for actions you take or fail to take based on AI-generated responses.

5. Use of the Bot

  • Permitted Use: You may use Kolai for lawful purposes, in accordance with these Terms, and solely for the purpose of receiving functionalities made available through the Bot.
  • Prohibited Activities: You agree not to:
    • Use the Bot to engage in unlawful, harassing, discriminatory, or fraudulent activities.
    • Exploit the Bot in a way that disrupts its normal functioning or compromises security.
    • Attempt to reverse engineer, decompile, or otherwise access or modify the Bot's source code.
    • Infringe upon or violate any intellectual property rights or proprietary rights of others.
  • Command Usage: Kolai may respond to commands or queries. You are solely responsible for content submitted via these commands. You must ensure that any shared or uploaded content complies with all laws and does not violate others' rights.

6. Intellectual Property

  • Ownership: All trademarks, service marks, logos, designs, software, and other intellectual property related to Kolai are owned by us or our licensors.
  • License Grant: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Kolai solely for its intended purposes on Discord.
  • Restrictions: You shall not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, or transmit any Kolai-related intellectual property without our prior written consent.

Kolai may provide links or references to third-party services, websites, or APIs. We have no control over these external platforms and disclaim liability for any content, practices, or policies on those platforms. You assume all risk arising from your use of such third-party resources.

11. Disclaimer of Warranties

  • As Is, As Available: Kolai is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Guarantee of Availability: We do not guarantee that Kolai will be uninterrupted, error-free, or secure.
  • No Results Guaranteed: Any predictions, analyses, or results derived from Kolai's features, including AI-based outputs, are informational only and may not be accurate.

12. Limitation of Liability

To the fullest extent permitted by law:

  • No Liability for Indirect Damages: We shall not be liable for any indirect, incidental, consequential, or special damages (including lost profits) even if advised of such possibility.
  • Aggregate Liability: Our total liability to you for all claims relating to or arising from Kolai shall not exceed the amounts paid by you (if any) for accessing or using Kolai in the twelve (12) months preceding the claim or one hundred Euros (100 EUR), whichever is greater.
  • User Responsibilities: You are responsible for your use of Kolai and for any decisions or actions taken based on the Bot's content, including AI-generated responses.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kolai AI, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of Kolai.
  • Your violation of these Terms or any applicable law.
  • Your infringement of any third-party right, including intellectual property or privacy rights.

14. Termination

  • By You: You may remove Kolai from your Discord server at any time to discontinue use.
  • By Us: We reserve the right to restrict or terminate your access to Kolai at any time, with or without notice, if we believe you have violated these Terms or any applicable law, or for any other lawful reason.
  • Effect of Termination: Upon termination, all licenses and permissions granted to you under these Terms will immediately cease. Sections related to disclaimers, limitation of liability, indemnification, and dispute resolution will survive any termination.

15. Governing Law and Dispute Resolution

  • Governing Law: These Terms and any disputes arising from them shall be governed by the laws of [Your Country/Region], without regard to its conflict of laws principles.
